Template document, not legal advice

This page is a template provided for information only. It is not a substitute for legal advice and has not been drafted or checked by a lawyer. Terms of Service

Last updated: [2-11-2026]

These terms are the rules for using BrokingFree, a service run by [StableStack LLP] ("we", "us"). By creating an account or using the site you agree to them. If you don't agree, please don't use BrokingFree.

1. What BrokingFree is

BrokingFree is an online platform that connects property buyers, owners and verified agents, and helps arrange property visits. We are not a party to any sale, purchase or rental of a property. Any agreement to buy or sell is between the buyer and the owner. We do not own, sell or rent the properties listed, and we do not guarantee that any deal will be completed.

2. Your account

  • You must be at least 18 years old and able to enter into a binding contract.
  • You log in with your mobile number and a one-time code. Give us accurate details and keep your phone secure.
  • You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
  • You may only have the role (buyer, owner or agent) you signed up for.

3. Acceptable use

You agree not to:

  • post false, misleading or fraudulent listings or information, or list a property you have no right to list;
  • upload photos or content you don't have the right to use, or that is unlawful, offensive or infringes someone else's rights;
  • harass, threaten or discriminate against other users;
  • try to break, overload or bypass the security or limits of the service, or use bots or scrapers without our permission;
  • use the service for anything illegal, or to avoid the platform in order to defeat its safeguards or fees.

4. Listings are reviewed before they go live

New listings, and listings that are edited, are reviewed by us before they appear to the public, and we may approve, reject or remove a listing at our discretion. This review is a basic check of the information provided. It is not a legal verification of ownership, title, approvals or condition of a property, and it is not a promise that a listing is accurate. Buyers should carry out their own checks (including title, RERA registration and legal documents) and take independent advice before paying any money.

5. Visits and agents

  • Buyers can request a visit. The owner can confirm it with an agent we have verified (KYC) and a time slot.
  • We arrange and track visits, but we do not control what happens during a visit and are not responsible for the conduct of owners or buyers.
  • Agent conduct: agents must be honest and professional; represent properties accurately; keep buyers' and owners' details confidential and use them only for the visit; keep their verification details accurate and up to date; and follow the law. [Confirm: agents must not charge buyers any brokerage or fee for a visit arranged through BrokingFree.]
  • We may suspend or remove an agent who breaks these terms or the law.

6. No brokerage for buyers

BrokingFree does not charge buyers brokerage for using the platform. Any other amounts, such as a refundable token held to lock a property, are explained in the app before you agree to them. Fees or commissions payable by owners or agents are set out [in the app / in a separate schedule: add details].

7. Tokens and refunds

A buyer may place a token on a property after a confirmed visit. While a token is held, the property is locked for that buyer for [7 days]. The token is refunded if the deal does not go ahead, or applied as described in the app if it does. [Have your lawyer review the exact token, refund and settlement terms and add them here.]

8. Content you provide

You keep ownership of the content you upload (such as property details and photos). By uploading it you give us a non-exclusive, free licence to store, display and use it to run and promote the service. You promise you have the right to give us that licence.

9. Privacy

How we handle your personal information is described in our Privacy Policy, which forms part of these terms.

10. Suspension and ending your account

You can stop using BrokingFree at any time and ask us to delete your account. We may suspend or close an account that breaks these terms, puts others at risk, or is used for fraud. Some terms (for example about liability) continue after an account ends.

11. Disclaimers and limit of liability

BrokingFree is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that the service will be uninterrupted or error-free, or that listings, users or agents are accurate or trustworthy, and we are not liable for losses arising from dealings between users or from properties, prices or documents shown on the platform.

To the extent the law allows, our total liability to you for any claim connected with the service is limited to [an amount to be decided with your lawyer], and we are not liable for indirect or consequential losses such as lost profit or opportunity. Nothing in these terms limits liability that cannot be limited by law.

12. Governing law and disputes

These terms are governed by the laws of India. The courts at [Amravati] have exclusive jurisdiction over any dispute, subject to any rights you have under consumer protection law. [Confirm jurisdiction, and whether to add an arbitration clause.]

13. Changes to these terms

We may update these terms. When we make an important change we will update the date above and, where appropriate, tell you in the app. Using BrokingFree after a change means you accept the new terms.
